These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Fluxxy ("we," "us" or "our"), concerning your access to and use of the Fluxxy website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

Age Verification and Adult Content

WARNING: The Site contains adult content, including explicit, mature, or otherwise age-restricted material. By accessing or using the Site, you acknowledge and agree to the following:

• You must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) to access and use the Site.
• You agree to submit to our age verification process (which may include self-certification or third-party age verification checks) before accessing any content.
• You will not allow any minor (under 18) to access the Site using your device or account.

AI-Generated Content and Intermediary Liability

All videos hosted on Fluxxy are entirely synthesized by artificial intelligence. By using the Site, you acknowledge and agree to the following regarding AI-generated content:

• No Copyright Claim: Raw AI-generated outputs currently do not qualify for traditional copyright protection. You may not claim exclusive copyright ownership over the raw generated videos hosted on this platform.
• Zero Tolerance for CSAM and Deepfakes: We strictly prohibit the generation, uploading, or hosting of Child Sexual Abuse Material (CSAM), non-consensual deepfakes representing real persons, or any content that violates criminal laws. Any such content will be immediately removed, and the generating account will be permanently banned and reported to relevant authorities.
• Intermediary Liability: Fluxxy acts as an aggregator and host of AI-generated media. While we use proactive filtering mechanisms, we are protected under applicable safe harbor laws for third-party or synthetically generated content. However, we comply strictly with expedited takedown requests for illegal content.

Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

User Representations

By using the Site, you represent and warrant that:

• You are at least 18 years of age and have passed our age verification process.
• All registration information you submit will be true, accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update such registration information as necessary.
• You have the legal capacity and you agree to comply with these Terms of Service.
• You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.

Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
